General, purchase and delivery conditions

The owner of the online shop Scandialco.com (hereinafter referred to as the Online Shop) is Herkut24 OÜ (registry code 16547551) located in Harju County, Tallinn, Haabersti, Rangu 10, 13522 (hereinafter referred to as the Online Shop or the Seller).

Validity of the sales contract, product and price information The sales conditions apply to the purchase of goods from the Online Store. The prices of the products sold in the online store are indicated next to the products.

A delivery fee is added to the price.

Information about the goods is provided on the Online Shop directly next to the goods.

The buyer pays for the goods by bank card or via a bank link on the website. The cost of the goods is calculated and carried out in euros.

Placing an order

To place an order, you need to add the desired products to your shopping cart. If the buyer proceeds from the shopping cart, they confirm their acceptance of the general, purchase and delivery conditions.

Next, the buyer will be redirected to the information request page, where the buyer enters their address and contact details, then the buyer will get an overview of the data entered where they
can also correct the data. If everything is correct, the buyer will be redirected to the order completion page where they will be presented with all the possible payment methods and the option to enter the billing address. Finally, the buyer completes the order and is sent back to the seller.

To place an order, you must fill in the required fields. The payment amount is then displayed on the screen, which can be paid by bank transfer: Swedbank, SEB, Luminor, LHV, Coop Bank, Pocopay, Liisi ID and Finora Capital or by credit card: Visa and Mastercard

 

The contract enters into force from the date of receipt of the amount due to the bank account of the Online Shop.

 

If the goods ordered cannot be delivered due to expiry of the goods or for any other reason, the buyer will be notified as soon as possible and the paid amount (including delivery costs) will be refunded immediately, but not later than 14 days after the notification.

 

The Online Shop has the right to withdraw from the sales contract and to demand the return of the goods from the buyer if the price of the goods in the Online Shop is indicated significantly below the market price of the goods due to a mistake.

Herkut24 OÜ's rights and obligations

Provide services in accordance with the legislation, the terms and conditions of services and the service specifications. Amend the terms and conditions of services and price lists by publishing information on the website.

Herkut24 OÜ is exempted from liability if damage to or loss of the consignment or any part of the consignment has occurred after the package has been handed over to the courier. Herkut24 OÜ will not be liable for the order if the address or telephone number provided is incorrect or does not exist; if the recipient no longer lives at that address; if the telephone number has changed, the order cannot be fulfilled.

Delivery:

The goods are delivered via DPD, Venipak, and the buyer selects their address when making the purchase, through which the parcel will be delivered to the buyer at their address.

Delivery is within Europe. The parcel is sent using DPD or Venipak delivery service. According to the courier's terms and conditions of services, the package will be handed over to the recipient against a signature on the basis of an identity document (passport, driving licence, ID card).

The delivery costs are paid by the buyer, and the corresponding price information is displayed in the shipping option, unless the delivery is free of charge for the buyer in accordance with these terms and conditions.

Although the Seller will do their best to ensure that the goods reach the buyer within 5 to 7 days after the sales contract enters into force, it should be taken into account that shipments within Europe may take 7 to 14 calendar days from the entry into force of the sales contract to reach the destination specified by the buyer.

Consumer's right of withdrawal

Pursuant to the Law of Obligations Act, the 14-day right of withdrawal does not apply to products purchased from the Online Shop, as these are goods that spoil or become out of date quickly and cannot be resold by the Online Shop.

Right to file a complaint

In the event that the Online Shop is in breach of its obligations, the buyer has the right to use the remedies provided for in the Law of Obligations Act, including the right to demand the fulfilment of the obligation from the Online Shop, to refuse to fulfil the obligation owed, to demand compensation for damages, price reduction, default interest in case of delay in the fulfilment of the financial obligation or to withdraw from the contract.

The complaint must state the name and contact details of the buyer, the date on which the complaint was filed, the defect in the goods and the content of the claim and must be accompanied by proof of purchase.

The Online Shop will respond to the complaint submitted by the consumer in writing or in a format that can be reproduced in writing within 15 days of receiving the complaint. If the goods purchased from the Online Shop have defects for which the Online Shop is responsible, the Online Shop will replace the defective goods.

In the event that it is not possible to replace the goods, the Online Shop will reimburse the buyer for all charges paid by the buyer in connection with the sales contract.

The Seller shall not be liable for any damage or any other consequences, including delay in delivery, resulting from incorrect information provided by the buyer when fulfilling the order if this is due to circumstances beyond the Seller's control.

The Seller shall not be liable for any defects arising after delivery of the goods to the buyer, nor for any damage caused by improper use of the goods.

Direct marketing and processing of personal data:

Customer's personal data disclosed during the process of placing an order in the Online Shop and during the purchase will be treated as confidential information. The Online Shop uses the personal data provided by the buyer (including name, telephone number, postal address, email address, bank details) only to process the order and send the goods to the buyer. The Online Shop transfers personal data to companies providing transport services in order to deliver goods.


Personal data entrusted to Herkut24 OÜ will be treated confidentially and will only be used for the purposes stated at the time of collection.


Herkut24 OÜ does not disclose the customer's personal data to third parties without the customer's permission.


Herkut24 OÜ is the controller of the personal data, and the personal data necessary for the execution of payments are transferred to the authorised processor Montonio OÜ.

The Online Shop will send newsletters and offers to the buyer's email address only if the buyer has expressed their wish to receive them by entering their email address on the website and indicating their wish to receive direct mail notifications. Buyers can opt-out of receiving offers and newsletters by email at any time by notifying the Seller by email or by following the instructions in the email containing the offers.

Settlement of disputes:

If the buyer has any complaints regarding the Online Shop, they should be submitted by email to info@scandialco.com.

If the buyer and the Online Shop are unable to settle the dispute through an agreement, the buyer can turn to the Consumer Disputes Committee of the Consumer Protection Board (https://ttja.ee/en/consumer-disputes-committee) or directly to the court.


There is no charge for having your complaint examined by the Consumer Disputes Committee.


In addition, the European Union's Online Dispute Resolution (ODR) platform, available at http://ec.europa.eu/odr, can be used to resolve complaints against e-retailers.
